Terms of Service

1. Parties and scope

These terms govern your use of the Myfinfolio website and application (the “Service”), operated by Controlplus services bv, a company incorporated in Belgium, VAT BE 0466.057.482 (“we”, “us”). By creating an account or using the Service you accept these terms. If you do not accept them, do not use the Service.

2. The Service

Myfinfolio lets you record your share and crypto positions, follow their value in your chosen currency using third-party market data, receive summaries and alerts, and generate an indicative annual overview of gains and losses. A demo mode with sample data is available so you can try the Service before entering your own data.

3. No financial, investment or tax advice

The Service is an information and administration tool only. Valuations, indicators, buy/hold/sell labels, summaries and annual overviews are generated automatically from third-party data and simple rules. They are not investment advice, a recommendation, a solicitation, or tax or accounting advice, and they are not a substitute for a professional adviser. Investing in shares and crypto-assets involves risk, including the risk of losing your entire investment. You are solely responsible for your investment decisions and for the tax returns you file. Tax figures shown are indicative and depend on the tax rate you enter yourself.

4. Accuracy of data

Market prices, exchange rates and news come from third-party sources. They may be delayed, incomplete or incorrect and are provided “as is”. We do not guarantee the accuracy, timeliness or availability of any data and are not liable for decisions taken on the basis of it.

5. Your account

You must be at least 16 years old and provide accurate registration details. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately at support@myfinfolio.io if you suspect unauthorised access.

6. Plans, prices and payment

The free plan allows up to five share or crypto positions. Myfinfolio Premium costs €5.99 per month, excluding VAT, and adds unlimited positions, the annual tax overview, and price alerts and notifications. Prices displayed in other currencies are indicative conversions; the amount actually charged is shown at checkout.

Payments are handled by Stripe. The subscription renews automatically each month until cancelled and is charged to your payment method on each renewal date. If a payment fails we may retry it and may suspend Premium features until payment succeeds.

7. Cancellation and right of withdrawal

You can cancel your subscription at any time from the membership page. Cancellation takes effect at the end of the current billing period; you keep Premium access until then and are not charged again. We do not refund partial months unless the law requires it.

As a consumer in the EU you normally have 14 days to withdraw from a distance contract. By starting your subscription and asking for immediate access to the digital service, you request that performance begins during the withdrawal period and acknowledge that your right of withdrawal is lost once the Service has been fully provided.

8. Acceptable use

You agree not to:

• use the Service unlawfully or for fraudulent purposes;
• copy, scrape, resell or redistribute market data, content or any part of the Service;
• attempt to access other users’ data or bypass technical restrictions;
• disrupt the Service through automated requests, reverse engineering or malicious code.

9. Your content

You keep all rights to the portfolio data you enter. You grant us a limited licence to store and process it solely to operate the Service, as described in the Privacy Policy. All software, design, text and trademarks in the Service remain our property.

10. Availability

We aim for continuous availability but do not guarantee uninterrupted or error-free operation. We may perform maintenance, change features, or discontinue parts of the Service. Where a change materially reduces a paid feature we will inform you in advance and you may cancel.

11. Liability

To the extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months preceding the event. We are not liable for investment losses, lost profits, incorrect tax filings, or indirect or consequential damage. Nothing in these terms excludes liability for fraud, wilful misconduct, gross negligence, death or personal injury, or any liability that cannot be excluded under mandatory consumer law.

12. Suspension and termination

You may delete your account at any time. We may suspend or terminate an account that breaches these terms, with notice where reasonably possible. On termination your data is handled as set out in the Privacy Policy.

13. Changes to these terms

We may amend these terms. Material changes will be announced in the application or by e-mail at least 14 days before they take effect. Continuing to use the Service after that date means you accept the new terms.

14. Governing law and disputes

These terms are governed by Belgian law. Disputes fall under the exclusive jurisdiction of the courts of Belgium competent for the seat of Controlplus services bv, without prejudice to the mandatory rights of consumers to bring proceedings in their country of residence. Consumers may also use the European Online Dispute Resolution platform.
